Constitution and bylaws is the foundational document that outlines the structure, governance, and operating procedures of a union’s bargaining unit. This document helps to ensure transparency, democratic decision-making, and the protection of members’ rights within the union.

Constitution

The constitution serves as the overarching framework for the union bargaining unit. It establishes the fundamental principles, goals, and structure of the union. Typically, it includes:

  • Name and Purpose: Defines the bargaining unit’s official name and objectives.
  • Membership: Outlines who qualifies as a member and their rights/responsibilities.
  • Structure and Governance: Describes leadership positions (e.g., President, Executive Members) and how they are elected.
  • Meetings and Decision-Making: Specifies when and how meetings occur, including quorum requirements and voting procedures.
  • Amendments: Explains how changes to the constitution can be proposed and adopted.

Bylaws

The bylaws provide more detailed rules and procedures for the daily operations of the union bargaining unit. They are often easier to amend than the constitution and can include:

  • Dues and Finances: Details membership fees, budget management, and financial reporting.
  • Elections and Terms of Office: Sets out election timelines, eligibility, and term lengths for union leaders.
  • Duties of Officers and Committees: Specifies responsibilities for executive members and committees.
  • Collective Bargaining Process: Explains how the bargaining unit negotiates contracts and engages in strikes or job actions.
  • Grievance and Dispute Resolution: Outlines procedures for handling member grievances against the employer.
  • Meeting Procedures: Details how meetings are conducted, including Robert’s Rules of Order or other procedural guidelines.

There are 3 sets of constitution and bylaws.

Any part of the Bargaining Unit Constitution, Bylaws, Policies, and/or Procedures which are in contravention to the Ontario Secondary School Teachers’ Federation and District Constitution, Bylaws, Policies and/or Procedures are null and void.
